SMS Terms of Service (Text Messaging Terms & Conditions)

These SMS Terms of Service (“SMS Terms”) apply to our text message program (the “Program”) operated by Portrait Pros (“we,” “us,” “our”). By opting in to receive SMS/text messages from us, you agree to these SMS Terms.

These SMS Terms are in addition to our other terms and policies, including our website Terms of Service and Privacy Policy.

1) Program Description

If you opt in to our Program, we may send you text messages about:

  • Promotions, offers, discounts, and announcements
  • Back-in-stock or service alerts (if applicable)
  • Cart reminders and personalized offers
  • Transactional messages related to your orders or appointments (such as confirmations, updates, reminders, and receipts), if you choose to receive them

2) How You Opt In

You may opt in by providing your mobile number through our website, checkout, a form, popup, or another opt-in method we make available (including, if offered, keyword/text-to-join).

By opting in, you expressly authorize Portrait Pros to send recurring text messages to the mobile number you provided, including by automated technology where permitted by law.

3) Consent Is Not a Condition of Purchase

Your consent to receive marketing text messages is not required as a condition of purchase. You may still purchase from us if you do not opt in.

4) Message Frequency

Message frequency varies based on your interactions with us and the type of messages you choose to receive.

5) Message & Data Rates

Message and data rates may apply. Your mobile carrier may charge you according to your plan. You are responsible for any fees related to receiving messages.

6) Supported Carriers + Delivery Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission from your carrier/network operator and is not guaranteed.

7) Opting Out (STOP) and Help (HELP)

You can cancel at any time by replying STOP to any message. After you send STOP, you may receive one final message confirming your opt-out.

8) Your Responsibilities

By participating in the Program, you represent that:

  • You are the subscriber or customary user of the mobile number you provided, or you have authorization to enroll that number.
  • You will provide accurate information and keep it updated.
  • If you change or deactivate your mobile number, you agree to opt out of the Program or notify us so messages don’t go to the wrong person.

9) Eligibility

You must be at least 18 years old (or the age of majority where you live) to participate, or have permission from a parent/guardian if required by law.

10) Privacy + Data Use

We value your privacy. When you join the Program, we collect and use information such as your phone number and your messaging interactions to:

  • Send you messages you requested
  • Provide customer support
  • Improve the Program (including analytics and performance)

We may share information with service providers that help us deliver messages and operate our store (including Shopify and messaging platforms). We do not sell or rent your phone number to third parties for their own marketing purposes.

11) Shopify + Third-Party Platforms

Our store may be hosted on Shopify, and we may use Shopify and/or third-party apps to power the Program. The Program is operated by Portrait Pros, not Shopify or wireless carriers, and Shopify and carriers are not responsible for the Program.

12) Changes to the Program or These SMS Terms

We may update these SMS Terms or change the Program at any time. Updates will be posted on this page with a new “Last updated” date. Your continued participation after changes are posted means you accept the updated SMS Terms.

We may suspend or terminate the Program (in whole or in part) at any time, to the extent permitted by law.

13) Disclaimer of Warranties

The Program is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14) Limitation of Liability

To the fullest extent permitted by law, Portrait Pros will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to the Program, even if advised of the possibility of such damages.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15) Governing Law

These SMS Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict-of-law rules, except where applicable law requires otherwise.
